1. Acceptance of Terms
These Terms of Service (“Terms”) govern access to and use of the JusticeWare platform (“Service”). By accessing or using the Service, you agree to be bound by these Terms.
If you are using JusticeWare on behalf of a court, government agency, municipality, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
JusticeWare is a cloud-based case management platform that provides software and related services for courts, government agencies, attorneys, justice partners, and authorized users.
JusticeWare provides technology services only and does not provide legal advice, legal representation, judicial services, or professional legal opinions.
3. Authorized Use
Users agree to:
- Provide accurate account information.
- Maintain the confidentiality of login credentials.
- Use the Service only for lawful purposes.
- Notify JusticeWare immediately of any suspected unauthorized access.
- Comply with all applicable laws, court rules, and organizational policies.
Users may not:
- Reverse engineer or attempt to gain unauthorized access.
- Circumvent security features.
- Introduce malware or malicious code.
- Interfere with the operation of the Service.
- Use automated tools except through documented APIs or with written authorization.
- Resell or sublicense the Service without written permission.
4. Customer Data
The customer retains ownership of all data submitted to the Service.
JusticeWare receives only the limited rights necessary to host, process, back up, secure, and transmit customer data in order to provide the Service.
Customers are responsible for ensuring they have the legal authority to upload and manage information within the Service.
5. Security
JusticeWare employs administrative, technical, and physical safeguards designed to protect customer information.
No computer system or communication network can be guaranteed to be completely secure. Users acknowledge that no method of electronic storage or transmission is entirely free from risk.
6. Availability
JusticeWare strives for high availability but does not guarantee uninterrupted or error-free operation.
Scheduled maintenance, emergency maintenance, third-party outages, internet failures, governmental actions, force majeure events, or circumstances beyond JusticeWare’s reasonable control may affect availability.
7. Third-Party Services
The Service may integrate with third-party providers including payment processors, identity providers, cloud hosting providers, email providers, SMS providers, document storage providers, mapping services, or other technology vendors.
JusticeWare is not responsible for the availability, security, or functionality of third-party services.
8. Electronic Communications
Users consent to receive transactional emails and SMS messages regarding:
- Account security
- Authentication codes
- Password resets
- Case notifications
- Filing confirmations
- Court reminders
- Other operational communications
JusticeWare does not send marketing or promotional text messages.

9. Intellectual Property
JusticeWare and its software, documentation, trademarks, logos, graphics, workflows, and technology remain the exclusive property of JusticeWare and its licensors.
Except for the limited license granted under these Terms, no ownership rights are transferred.
10. Acceptable Use
Users shall not:
- Upload unlawful or infringing material.
- Attempt to access another customer’s data.
- Perform security testing without authorization.
- Use the Service to violate privacy or confidentiality obligations.
- Use the Service for illegal activity.
JusticeWare may suspend accounts engaged in prohibited activities.
11. Privacy
Collection and use of personal information is governed by the JusticeWare Privacy Policy, which is incorporated into these Terms by reference.
12. Suspension and Termination
JusticeWare may suspend or terminate access when reasonably necessary to:
- Protect system security.
- Prevent fraud or abuse.
- Comply with legal obligations.
- Enforce these Terms.
- Protect other customers or the integrity of the Service.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTICEWARE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTICEWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL.
JUSTICEWARE’S TOTAL LIABILITY ARISING FROM THE SERVICE SHALL NOT EXCEED THE FEES PAID BY THE CUSTOMER TO JUSTICEWARE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THOSE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
15. Indemnification
The customer agrees to defend, indemnify, and hold harmless JusticeWare, its officers, employees, contractors, and affiliates from claims arising out of:
- Customer misuse of the Service.
- Violation of these Terms.
- Violation of applicable laws.
- Content or data submitted by the customer.
- Customer negligence or misconduct.
16. Export Compliance
Users agree to comply with applicable U.S. export control and sanctions laws and regulations.
17. Force Majeure
JusticeWare shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, internet failures, utility outages, governmental actions, cyberattacks, or failures of third-party infrastructure providers.
18. Governing Law
Unless otherwise provided in a written agreement, these Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
19. Changes
JusticeWare may modify these Terms from time to time. Updated versions will be posted on this website. Continued use of the Service constitutes acceptance of the revised Terms.
